RISING ORCHARDS, LLC
Terms of Service
Last updated: September 19, 2026
1. The service and this agreement
Scene Dept. is a production-planning application operated by Rising Orchards, LLC. These Terms apply to scenedept.com, the hosted app, its APIs, and connections you authorize. By creating an account or using the service, you agree to these Terms. If you act for an organization, you must have authority to bind it; otherwise, do not use the service on its behalf.
Scene Dept. and IgorBox are products of Rising Orchards, LLC. IgorBox is also a registered DBA of Rising Orchards, LLC, and the Scene Dept. plugin is published under the IgorBox business identity. Rising Orchards, LLC remains the legal operator of Scene Dept. and the party to these Terms.
You must be at least 18 and able to enter a binding agreement. Scene Dept. is currently in public beta. Features, availability, limits, and integrations may change. A future feature, subscription, or integration is not a promise of delivery. IgorBox products and services have their own terms.
2. Accounts, access, and collaborators
Provide accurate account information and protect your credentials and authorized connections. Tell us promptly if you suspect unauthorized access. You are responsible for actions you take and instructions you give through your account, including to an assistant or automation.
Project owners control invitations and access roles. Only invite people you are entitled to share the project with. A collaborator or connected service may read, edit, export, or retain information within the permissions you grant. Removing access does not recall copies already downloaded, emailed, or sent to another service.
3. Your work and our permission to operate the service
You retain your rights in your scripts, outlines, shot lists, visual notes, and other project content. You are responsible for having the rights, permissions, releases, and lawful basis needed to upload, process, and share it, including information about cast, crew, or other people.
You grant Rising Orchards, LLC a limited, nonexclusive license to store, reproduce, process, format, and transmit your content as needed to provide and secure the service and perform actions you request, including collaboration, exports, and authorized integrations. This does not transfer ownership or give us permission to publish your private projects as marketing material.
The application, branding, and service materials remain owned by Rising Orchards, LLC or their licensors. Your access is permission to use the service under these Terms, not a transfer of those rights. Separate open-source licenses govern components covered by them. You allow us to use voluntary product feedback without compensation or an obligation to implement it.
IgorBox is a registered trademark of Rising Orchards, LLC. Scene Dept. is a product name of Rising Orchards, LLC. These Terms do not grant permission to use either brand beyond what applicable law allows.
4. AI assistants and automation
Scene Dept. currently offers tools that compatible external AI clients can access through authorized connections. A connection can expose project information to that client and, if write access is granted, make changes on your behalf. Review the selected projects, scopes, and the provider’s terms before connecting. You can revoke a connection in the app; revocation stops future authorized access but cannot erase information the provider already received.
Depending on your connection scope and existing permissions, an authorized assistant can also read team membership and invitation information, manage project or team access, delete permitted content, and send reports or invitations by email on your behalf. These actions must follow your instructions and remain subject to the same access controls as the app. Review the intended recipients, roles, and content before requesting sharing, access changes, or deletion. Sent emails cannot be recalled by revoking the connection.
AI suggestions and actions can be inaccurate, incomplete, biased, similar to another person’s work, or unsuitable for your production. Check edits, factual claims, rights, releases, and safety decisions before relying on them or distributing output. AI output is not professional legal, technical, or safety advice. We do not promise originality, exclusivity, copyright eligibility, non-infringement, or a particular result from AI-assisted work.
Do not send passwords, secrets, or information you are not authorized to disclose to an assistant. External providers apply their own retention and model-training policies. Scene Dept. does not train AI models on private project content. Any first-party AI feature will need its own clear data-use disclosure before you use it; these Terms are not blanket consent to train on private projects.
Your use of a connected AI service is also governed by that provider’s terms and privacy policy. Rising Orchards, LLC does not control that provider’s processing, retention, or use of information it receives through your authorized connection. This does not limit our responsibilities for our own service, disclosures, security, or transfers of information, or any responsibility that cannot be excluded under applicable law.
You remain responsible for reviewing your production plan and for the permissions you grant. A saved plan, generated checklist, or completed shot status is not a verification that the work is safe, legal, or complete.
5. Acceptable use and production responsibility
Do not use the service for unlawful activity, infringement, harassment, fraud, or malicious content. Do not attempt unauthorized access, bypass access controls, disrupt the service, or use automation to evade limits. Do not misrepresent AI-generated material or another person’s identity in ways that violate applicable law or rights.
You are responsible for your actual production: competent crew, permits, releases, equipment, locations, insurance, and safe operating procedures. Scene Dept. is a planning tool, not a safety system or a substitute for qualified supervision. Do not rely on it to control a hazardous effect or make a safety-critical decision.
6. Beta availability, subscriptions, and your copies
Beta access can be limited, interrupted, changed, or withdrawn. Keep independent copies of work you need; project data and reports can be exported. We do not guarantee that beta data, features, or access will be available indefinitely.
Public beta allowances are subject to reasonable technical and abuse-prevention limits, including per-file upload validation, workspace storage limits, request limits, and editor capacity. Current allowances may change before paid plans launch. We will not charge you unless you affirmatively choose a paid offering presented with its price and terms.
If we offer paid plans, the price, billing period, renewal, cancellation, and applicable refund terms will be presented before purchase. Merely joining the beta does not authorize future charges. No purchase is required by these Terms alone.
7. Suspension, termination, and changes
You may stop using the service at any time and contact us to request account closure. We may restrict or end access for violations, security risks, legal obligations, or discontinuation of the service. Where reasonably possible and lawful, we will provide notice and an opportunity to export your work. Urgent security or abuse situations may require immediate action.
We may revise these Terms and will post the revised date. Material changes will be brought to your attention through the service or email where appropriate, with additional agreement where required by law. Changes do not retroactively expand permission to use private content. Provisions that by their nature need to survive account closure, including intellectual property and dispute provisions, survive.
8. Warranties and limits on liability
To the extent allowed by law, the service is provided as available, without a promise of uninterrupted or error-free operation, fitness for a particular purpose, merchantability, or non-infringement. We cannot guarantee the performance or availability of an external AI client or other third-party service.
To the extent allowed by law, Rising Orchards, LLC is not liable for indirect, consequential, special, or punitive losses, including lost profits or opportunities, arising from use of the service. Our total liability relating to the service is limited to the greater of US $100 or the amount you paid for Scene Dept. during the 12 months before the event giving rise to the claim.
These exclusions do not limit liability that cannot lawfully be limited, including applicable consumer rights, fraud, willful misconduct, or other non-excludable liability. They apply only to the extent permitted in your jurisdiction.
9. Third-party claims and disputes
To the extent permitted by law, you agree to cover reasonable costs and losses from third-party claims caused by content you supply in violation of others’ rights, your unlawful use, or your material breach of these Terms. This does not apply to claims caused by our own unlawful conduct. We will notify you of a claim and reasonably cooperate; you may not settle it in a way that admits fault or imposes obligations on us without our consent.
Florida law governs this agreement, except where mandatory local law provides otherwise. Unless applicable law requires another forum, disputes may be brought in state or federal courts serving Volusia County, Florida. Please contact us first so we can try to resolve a concern informally. Nothing here removes nonwaivable consumer rights or access to a competent regulator or court.
